It is hereby made public that at a meeting of the Municipal Council, held on 16 March 2022, by decision no. 105/2022, as a local government body and within its powers as a public employer, the “Code of Ethics and Good Conduct” of the Municipality of Seixal was approved by majority, drafted under article 136(4) of the Administrative Procedure Code, following consultation with all workers’ representative structures, for the purposes set out in article 75(2) of the General Law on Public Employment, approved in annex to Law no. 35/2014, of 20 June, in its current wording, read together with article 33(1)(k) of Law no. 75/2013, of 12 September, in its current wording, and article 19(1) and (2)(c) of Law no. 52/2019, of 31 July, which will enter into force on the day after its publication. “Code of Ethics and Good Conduct” — Municipality of Seixal Explanatory note A code of ethics and good conduct contains rules that regulate the behaviour of people within an organization, in the present situation the workers, in the relationships established among themselves, as well as in their relations with the outside world, in the mission of pursuing and satisfying the public interest. With the entry into force of Law no. 73/2017, of 16 August, rectified by Rectification Statement no. 28/2017 of 2 October, we have witnessed a strengthening of the legislative framework for the prevention of harassment in the private sector and in Public Administration, making the twelfth amendment to the Labour Code, approved in annex to Law no. 7/2009, of 12 February, and the sixth amendment to the General Law on Public Employment, approved in annex to Law no. 35/2014, of 20 June. The Labour Code, in article 29, reinforces the prohibition of harassment and article 127(1)(k) determines, within the employer’s duties, the adoption of codes of good conduct for the prevention and combat of harassment at work, whenever the company has seven or more employees and the initiation of disciplinary proceedings whenever situations that may amount to workplace harassment come to its attention. The General Law on Public Employment, under article 71(1)(k), determines the adoption of codes of good conduct for the prevention and combat of workplace harassment and the initiation of disciplinary proceedings whenever alleged situations of workplace harassment come to light. With the rules set out in this Code, alongside the public commitment already assumed to defend values of non-discrimination and to prevent and combat harassment in the workplace, the aim is to discourage these behaviours, with ethical and even financial gains, avoiding administrative or court proceedings and the costs inherent to them. Thus, a draft regulation for the Code of Ethics and Good Conduct is presented, updated in accordance with the legislation in force. In compliance with article 75(2) and article 327(c) of the General Law on Public Employment, the entities mentioned therein were consulted. This Code of Ethics and Good Conduct for the Prevention and Combat of Harassment at Work, as a self-regulatory instrument adopted by the Municipal Council of Seixal, for the purposes set out in article 71(1)(k) of the General Law on Public Employment, published in annex to Law no. 35/2014 of 20 June, in its current wording, was approved by decision no. 105/2022 at the Municipal Council meeting of 16 March.
